Terms of Service

These Terms govern your access to and use of digi-cam. If you do not agree, do not use the app.

Effective Date: February 16, 2026

1. Agreement to Terms

By creating an account, accessing digi-cam, or using digi-cam features, you agree to these Terms of Service and the Privacy Policy.

2. Eligibility

You must be at least 13 years old (or the higher minimum age required by your jurisdiction), have capacity to enter this agreement, and not be prohibited by law from using the service.

3. Accounts and Security

  • digi-cam uses phone number OTP authentication and may support guest flows.
  • You are responsible for activity under your account and for device and credential security.
  • You must provide accurate information and keep it current.
  • We may restrict access where account integrity, abuse prevention, or legal compliance requires it.

4. Limited License to Use digi-cam

Subject to these Terms, digi-cam grants you a limited, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial purposes.

5. User Content Ownership and License Grant

You retain ownership of content you submit (including posts, messages, comments, profile details, and media). You grant digi-cam a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, adapt, display, and distribute that content solely to operate, secure, improve, and provide digi-cam features.

6. Feedback

If you submit feedback, suggestions, or ideas, you grant digi-cam the right to use them without restriction or compensation to you.

7. Acceptable Use and Prohibited Conduct

You must not use digi-cam to:

  • Harass, threaten, abuse, or exploit others.
  • Post illegal, infringing, deceptive, or fraudulent content.
  • Share hate speech, terrorism advocacy, sexual exploitation material, or non-consensual intimate content.
  • Spam, scrape, automate abuse, or manipulate engagement.
  • Attempt unauthorized access, disrupt service operation, or bypass technical safeguards.

8. Audience Controls and Privacy Expectations

digi-cam provides audience controls (public, private, circle-based), but you are responsible for selecting your audience and the risks of sharing. Recipients may still capture or re-share accessible content.

9. Messaging Conduct

digi-cam direct messaging is one-to-one. You may not use messaging for harassment, coercion, unlawful activity, threats, or impersonation. Abuse may result in restrictions or termination.

10. Moderation and Enforcement

To protect users and the platform, digi-cam may:

  • Remove or restrict content.
  • Limit, suspend, or terminate accounts.
  • Act on reports, blocks, legal requests, and abuse signals.
  • Preserve and disclose records where necessary for safety, legal, or security reasons.

11. Intellectual Property

digi-cam and its branding, software, and service materials are protected by intellectual property laws. Except for the license in these Terms, no rights are granted to you.

12. Infringement Notices (DMCA-style)

To report alleged infringement, contact afkswitz@gmail.comwith sufficient details to identify the work, the allegedly infringing material, and your authority to make the report.

13. Third-Party Services

digi-cam relies on third-party providers (including Firebase, APNs, and Apple ecosystem APIs). Your use of integrated services may also be subject to third-party terms and privacy policies.

14. Apple App Store Terms

  • If you access digi-cam through an Apple device, this license is limited to use on Apple-branded products you own/control under Apple media services rules.
  • Apple has no obligation to provide maintenance or support for digi-cam.
  • Apple is not responsible for product claims, legal compliance claims, intellectual property claims, or third-party claims related to digi-cam.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce applicable provisions.

15. Paid Features

digi-cam may introduce paid features in the future. If introduced, pricing, billing terms, refunds, and taxes will be shown at purchase time and become part of these Terms.

16. Service Changes and Beta Features

digi-cam may modify, suspend, or discontinue any feature at any time, including beta functionality. We do not guarantee uninterrupted, error-free, or always-available service.

17. Disclaimer of Warranties

To the fullest extent permitted by law, digi-cam is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and availability.

18. Limitation of Liability

To the fullest extent permitted by law, digi-cam and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business interruption. digi-cam's aggregate liability for any claim arising from these Terms will not exceed the greater of USD $100 or the amount you paid digi-cam in the 12 months before the claim arose.

19. Indemnification

You agree to defend, indemnify, and hold harmless digi-cam, its affiliates, and service providers from claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your content, your misuse of digi-cam, or your violation of these Terms or applicable law.

20. Termination and Survival

You may stop using digi-cam at any time and request account deletion. digi-cam may suspend or terminate access for violations, legal risk, security concerns, or abuse. Provisions that by nature should survive termination will survive, including intellectual property, disclaimers, liability limits, indemnity, and dispute terms.

21. Binding Arbitration and Class Action Waiver

Except for qualifying small claims and requests for injunctive relief, disputes arising from these Terms or digi-cam will be resolved by final and binding arbitration on an individual basis. You and digi-cam waive any right to a jury trial and any right to participate in a class, collective, representative, or mass action.

You may opt out of arbitration by emailing afkswitz@gmail.com within 30 days of first accepting these Terms, including your full name and account identifier with a clear opt-out statement.

22. Governing Law

These Terms are governed by the laws of the State of California, excluding conflict-of-law principles, and by the U.S. Federal Arbitration Act where applicable.

23. Export and Sanctions Compliance

You may not use digi-cam in violation of U.S. export controls or sanctions laws, and you represent you are not prohibited from receiving services under applicable export and sanctions rules.

24. General Terms

If any provision is unenforceable, the remaining provisions stay in effect. digi-cam's failure to enforce a provision is not a waiver. digi-cam may assign these Terms in connection with a merger, acquisition, or asset transfer. You may not assign these Terms without consent. digi-cam is not liable for delay or failure caused by events beyond reasonable control.

25. Updates to Terms

We may revise these Terms. Updated Terms are posted with a revised effective date. Continued use after the effective date means acceptance of the revised Terms.
